The legal status of legal agreements is sometimes difficult to pin down – is it laws or treaties? There are different categories (see Seddon, government contracts: federal government, Länder and municipalities, paragraph 3.9). In Mineralogy Pty Ltd v Western Australia [2005] WASCA 69 to [13], it was concluded that the agreement under the Contracts Act was contractual: “The agreement shall not be construed as law”.
